Application means the software program provided by the Company downloaded by You on any electronic device, named SURAKSHAKADI

Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the Application has been downloaded.

Affiliate means an entity that controls or is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.

The country refers to India.

Company (referred to as either "the Company,” "We,” "Us," or "Our" in this Agreement) refers to SURAKSHAKADI DIGITAL ESTATE SERVICES PRIVATE LIMITED or SURAKSHAKADI.

Device means any device that can access the Service, such as a computer, a cellphone, or a digital tablet.

Service refers to the bundle of services purchased through the annual or lifetime subscription plans, electronic extended Will writing service, or an optional service of putting users in touch with lawyers on a cost-and-effort basis and or specific paid quotation service over the mobile Application or the Website, or both.

Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

Third-party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service.

The website refers to SURAKSHAKADI, accessible from https://www.surakshakadi.com.

You/User/Consumer means the individual accessing or using the Service, the company, or other legal entity on behalf of which such individual is accessing or using the Service, whether by surfing, reading, viewing, using, and/or purchasing the documents and/or subscribing to the services, and/or specific paid quotation for the service offered on the Application or the Website, or both, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement between You and the Company. These Terms and Conditions outline the rights and responsibilities of all users in relation to the Service.

Your access to and utilization of the Service is contingent upon your acceptance of and adherence to these Terms and Conditions. These Terms and Conditions are applicable to all visitors, users, and individuals who access or utilize the Service.

By accessing or using the Service, you hereby agree to be bound by these Terms and Conditions. In the event of disagreement with any part of these Terms and Conditions, you must refrain from accessing the Service.

You affirm that you are of legal age, being over 18 years old. The Company does not permit individuals under the age of 18 to utilize the Service. Through User Registration, you acknowledge and affirm that you are at least eighteen years old, and possess the legal competence to enter into a binding contract with the Company concerning the use of the Application and/or Website.

Furthermore, your access to and utilization of the Service is also subject to your acceptance of and compliance with the Company's Privacy Policy. Our Privacy Policy delineates Our procedures and policies regarding the collection, usage, and disclosure of your personal information when you utilize the Application and/or the Website. It also informs you of your privacy rights and the legal protections in place. It is important to note that neither the company, the application, nor the WEBSITE of Surakshakadi provides legal advice.

The design of the documents presented on the application and/or the WEBSITE is entirely automated and does not result from any manual writing, editing, or modification by the director, the company’s employees, SURAKSHAKADI, the company's partners, or any other individual.

This document constitutes an electronic record in accordance with the Information Technology Act, 2000, and the rules and amendments pertaining to electronic records in various statutes, as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not necessitate physical or digital signatures. This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011, which mandates the posting of rules and regulations, privacy policy, and user agreement for access or usage of the Application and/or Website.

We retain the right to periodically revise, update, or modify the Terms of Use without prior notice. We urge you to periodically review this document for updates and to ensure your familiarity with the most current version. Unless otherwise specified in such revisions, the revised User Agreement, or its components, shall become effective upon posting, denoted as the "Last Revised Date."

We kindly request that you carefully read these Terms of Use. By accessing and utilizing the Application and/or Website, you explicitly agree to be bound by these Terms of Use. Unless explicitly stated otherwise, any new features that expand or enhance the Application and/or Website shall be subject to these Terms of Use.

We may collaborate with banks, financial institutions, insurance advisors, or other corporate bodies and individuals (Affiliates) to create awareness, market, and sell our product/s.

The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party applications, Websites, or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party applications, websites, or services you visit.

Termination

You will not use the Application and/or Website for any purpose that is unlawful or prohibited by these Terms.

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

Regardless of any damages you may incur, the total liability of the Company, along with its suppliers, service providers, and partners under any provision of these terms, as well as your exclusive remedy for all such matters, will be restricted to the amount paid by you through the Service or Rs 500/- if you have not made any purchases through the Service.

To the maximum extent allowed by applicable law, under no circumstances shall the Company, its suppliers, service providers, or partners be held liable for any special, incidental, indirect, or consequential damages whatsoever. This includes, but is not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, or loss of privacy arising from or in any way related to the use of, or inability to use, the Service, third-party software, and third-party hardware used with the Service, or otherwise connected with any provision of these terms. This holds true even if the Company or any suppliers, service providers, or partners have been informed of the possibility of such damages, and even if the remedy fails in its essential purpose.

The liability of each party will be restricted to the maximum extent permitted by law in the respective country.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, concerning the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of a course of dealing, course of performance, usage or trade practice. Without limitation to the preceding, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the preceding, neither the Company nor any of the company's providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case, the exclusions and regulations outlined in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your application use may also be subject to local, state, or national laws. In case of doubt regarding any of these Terms and Conditions, USER acknowledges that the Indian Consumer Code and the customs in force in the Indian e-commerce industry apply. Our product/s and other service/s are designed to be suitable for the application of the law of India for Indian citizens and NRIs having assets/properties in India. If an individual has any assets outside India, it is advisable to create a separate Will in that country as per their local laws. However, if you generate Will using our services for those foreign assets, the possible legal issues arising in the future will be entirely at your own risk.

Disputes Resolution

USER further acknowledges that any dispute resolution required, including arbitration, litigation, or another method, shall exclusively be done in Lucknow, India. Specifically, any litigation under these Terms And Conditions will be exclusively before a court of competent jurisdiction in Lucknow.

To the fullest extent permitted by law and especially in case of any dispute between the parties, the controlling language for these Terms And Conditions is English.

In case of any dispute or claim, however, before undertaking any method involving a third party, the USER agrees first to contact SURAKSHAKADI directly or informally by contacting the Company so that the parties may come to an amicable solution.

Severability and Waiver

Severability

Suppose any provision of these Terms is held to be unenforceable or invalid. In that case, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law. The remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require the performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time after that, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Users can effortlessly create, update, and manage comprehensive end-of-life plans through our intuitive platform. Our services encompass secure Will creation, reinforced by the collection of video evidence, confidential asset wallet management, and the provision of secured term-life insurance. Additionally, we collaborate with legal experts, recommend trusted service providers, and actively engage with government initiatives to streamline and simplify the asset transfer process. The distinctive features of our transparent and cost-effective approach, combined with a comprehensive suite of services, establish Surakshakadi as a trustworthy and convenient solution for hassle-free asset transfer, ensuring financial well-being and peace of mind for our subscribers and their legal heirs.

Services

1. Account Access and Subscription:

  • To access the online asset transfer service, you are required to log in with a mobile OTP for your application and/or website account, and providing your mobile number is necessary.
  • Upon subscribing to the service, you must agree to provide accurate personal information and commit to keeping this information up-to-date. Additionally, you will be required to make an online payment to authorize Surakshakadi as the executor for your Electronic Extended Will, prepared based on the information you provide. After making the payment, you will have a 60-day window to complete the details for your Will and Asset wallet.

 

2. Account Termination and Refusal:

  • We retain the right to terminate accounts of users who engage in identity theft or provide incomplete or inaccurate information, which may result in the cancellation of your account.
  • We also reserve the right to refuse approval of a user account or terminate an existing account, with or without prior notice, except as required by applicable law. Surakshakadi will not be liable for any losses or damages resulting from account termination or service refusal.

 

3. Two-Factor Authentication:

  • Subscribers to the service will receive two-factor authentication (Mobile OPT and email PIN) to securely access legal documents, asset information, and their preferences.

 

4. Security and Reporting:

  • It is mandatory for customers to promptly report any misuse of login credentials or unauthorized access to their Electronic Extended Will and Asset Wallet. In such cases, we will take appropriate actions, which may include temporarily blocking or Deactivating or changing login credentials.
  • You are responsible for maintaining the confidentiality of your login credentials and must refrain from sharing your account details with others. Notify us immediately if you suspect unauthorized account usage, as SURAKSHAKADI DIGITAL ESTATE SERVICES PVT LTD will not be responsible for any information or asset mishandling or misuse.

 

5. Electronic Extended Will Details:

  • Electronic Extended Will allow you to plan for posthumous events, although it may not cover all possible scenarios.
  • To create an Electronic Extended Will, you must provide all necessary details in the format specified by the software/app. The technology used will extract the information through a questionnaire/form.

 

6. Payment and Account Deactivation:

  • If you make a payment to Surakshakadi, we will remind you to draft your Will within 60 days using our application software. Failure to do so will result in account deactivation, erasing all previously filled information. Surakshakadi will not refund payments or recover lost information. A new registration and payment will be required to continue work on your new subscription.

 

7. Review and Amendment:

  • You are required to read, review, and verify the entire Electronic Extended Will. If any aspects make you uncomfortable or do not address your unique circumstances, you may raise a ticket for review. However, please note that backend corrections are minimal, as the document is automated based on your inputs.

 

8. Legal Documentation and Witnesses:

  • To ensure the legal validity of your Will, it must be printed, signed by you, and also signed by two witnesses. The signed copy is required to be uploaded back into the application, enabling us to provide the necessary services in accordance with your wishes upon your demise.

 

9. Legal Assistance:

  • We can assist you in finding advocates, consultants, clerks, and others to help with registering and notarizing your Will in India through trusted partner organizations, ensuring a legal asset transfer process according to Indian law.

 

10. Asset Transfer for Non-Subscribers:

  • If you are not subscribed to any of our plans and wish to use our asset transfer services, contact us via the mobile application and/or website. Share basic asset details, pay minimal charges, and we will provide you with a quotation. Upon approval of the quote, make the payment to initiate the service.

 

11. Will Revocation and Executor Appointment:

  • By accepting our terms, you affirm that you have not crafted any alternative will or testamentary document. In the presence of any such documents, you explicitly revoke all prior wills and codicils, asserting that the Will generated through Surakshakadi's platform application stands as your ultimate testament.
  • You also authorize SURAKSHAKADI DIGITAL ESTATE SERVICES PVT LTD or its designated personnel as the executor of your Will. The executor is responsible for administering the estate, including asset collection, debt payment, and asset distribution according to the Last Will's instructions.

 

12. Group Term Life Insurance Coverage:

  • Granting authorization to the Company facilitates a group term life insurance coverage of up to five lakh rupees, a critical element in fulfilling your expressed wishes within your Will for the seamless transfer of assets to legal inheritors. The issuance of the policy and settlement of the sum assured are pivotal prerequisites, as the sum assured plays a key role in facilitating the asset transfer process. In the event that the insurer issues a cheque in the inheritor/s' name, their cooperation is imperative, with an understanding that the sum assured is exclusively earmarked for Will execution and asset transfer through Surakshakadi. Should the insurer request it, the legal heir may be required to sign the Memorandum of Understanding (MoU) to enable the utilization of the sum assured for delivering the asset transfer service.

 

13. Government, Regulatory Body, Trustee and Court Fees:

  • The legal inheritor bears the responsibility for fees associated with government, regulatory, trustee, stamp duty, or court proceedings linked to the asset transfer. These fees are contingent on the size of the asset and are subject to regulations set by city or state authorities, which may undergo revisions. Our company cannot cover these fees, and while we lack control over them, we are committed to transparent communication with the legal inheritor(s) regarding the latest applicable fees. This ensures they are well-informed, and their timely payment is crucial for facilitating the asset transfer process through our company.

 

14. Accuracy and Legal Compliance:

  • You acknowledge that all information you provide is accurate, complete, and correct. Failure to maintain accuracy may result in subscription cancellation, and SURAKSHAKADI DIGITAL ESTATE SERVICES PVT LTD will only deliver asset transfer services if the information you supply is truthful and unchallenged in court.

 

15. Legal Requirements and Cooperation:

  • Asset transfer services require a Death certificate, Letter of Administration (Probate), or Succession certificate issued by the court, if necessary. Legal obstacles may also affect the process, requiring timely cooperation to resolve. SURAKSHAKADI DIGITAL ESTATE SERVICES PVT LTD cannot provide asset transfer services without these documents when needed.

 

16. Coverage and Expenses:

  • The asset transfer services, as outlined in the chosen subscription plan, cover associated costs. This excludes government, regulatory, stamp duty, appointed trustee fees, and court fees, where applicable. It's imperative to highlight that non-cooperation from designated legal inheritor(s) may result in service termination after two consecutive follow-up attempts for fee payment.
  • For Users Aged 60 and Above: Legal heirs of individuals/subscribers aged 60 and above bear sole responsibility for covering all actual charges/fees related to asset transfer, with Surakshakadi facilitating the asset transfer process. The initiation of the asset transfer service by Surakshakadi is contingent upon the legal inheritor settling any such charges/fees. This transparent approach ensures a clear understanding of the financial responsibilities involved. In contrast to younger age groups, we are unable to secure coverage for users above 60 through insurance or any financial external entities to aid the asset transfer. Therefore, the fees are essential to maintain the quality and effectiveness of our service, highlighting the legal heir/s' accountability for the associated charges and upholding transparency throughout the entire procedure.

 

17. Legal Disputes and External Assistance:

  • You confirm that there are no pending legal disputes or litigation related to the assets you wish to transfer to your legal inheritor. While we can assist your legal inheritor in finding legal professionals, SURAKSHAKADI DIGITAL ESTATE SERVICES PVT LTD will not cover the costs of such matters.
  • It is essential to acknowledge that, in accordance with legal requirements, two attesters/witnesses are mandatory for the Will. These individuals may be required to appear in court if deemed necessary. Please be aware that any refusal by the attesters/witnesses may hinder our ability to provide the necessary services.

 

18. Legal Inheritor's Freedom:

  • You acknowledge that your legal inheritor has the freedom to hire an external lawyer if they want at their own expense, SURAKSHAKADI DIGITAL ESTATE SERVICES PVT LTD will not cover the costs of such matters.

 

19. In-Person KYC Requirements:

  • You understand that your legal inheritor may need to visit our offices or cooperate with our executor for in-person KYC (Know Your Customer) procedures as required by institutions during the asset transfer process or closure.

 

20. Group Term Life and Group Personal Accident Insurance:

  • The company can discontinue "Group Term Life and Group Personal Accident" insurances in response to unfavorable market conditions or board decisions. This insurance, acquired for M/s SURAKSHAKADI DIGITAL ESTATE SERVICES PRIVATE LIMITED customers, may involve changing the insurance provider annually as necessary. Your acceptance of these terms permits us to share your information with our insurance partner, the insurance provider, or an authorized broker to facilitate insurance procurement. The insurer takes full responsibility for the policy's terms, conditions, and any specific inclusions or exclusions outlined in the Policy.

 

Cancellation and Refund

    • If you encounter specific operational or technical issues preventing the generation, printing, or saving of an Electronic Extended Will, and we are unable to rectify the matter within 72 hours, you are eligible to request a refund.
    • Refund Process: We will initiate the refund to the same Payment ID used for the original payment. The initiation will occur within 48 hours of the approval of the Refund Claim, acknowledging our failure to resolve a technical issue.

    • Refund Limitations: Refund claims cannot be entertained once the eKYC is completed, the Electronic Extended Will document is generated using our application, or you have availed our doorstep service for document signature at home.
    • Offline Services: For offline services, you may request a refund if our services do not meet your requirements, experience delays exceeding 72 hours, or fall below the usual industry standards, with the condition that we are unable to address the delay and quality concerns within 48 hours.
    • Discretionary Refunds: The determination of whether a specific case qualifies for a full refund rests solely with Surakshakadi.
    • Deductions: Any refunds processed are subject to deductions for payment gateway and government charges paid by us, if applicable.

Confidentiality

Our online services uphold the highest confidentiality and data security standards. Advanced measures are seamlessly integrated to safeguard your information and prevent unauthorized access. Your data, comprising limited details such as name, email address, city, and phone number, will be treated with the utmost confidentiality. Access to our product software is restricted to authorized users only, ensuring a secure environment. Specific information may be shared exclusively with the referring company/entity/partner involved in providing insurance coverage. This transparent sharing is designed to optimize service delivery, assist in insurance processes, and provide timely reminders while upholding strict confidentiality standards.

Payments

Payment for our online services is seamlessly processed through the designated methods specified on the Application and/or Website, leveraging a secure payment gateway. In utilizing the payment gateway, we reserve the right to apply and recover associated fees. It is important to note that all services are subject to prevailing Goods and Services Tax (GST) rates. Adherence to these payment terms is crucial to ensuring a seamless and efficient transaction process.

Additionally, we explicitly prohibit any transactions involving cash. Please refrain from engaging with any individuals or entities, including affiliates, brokers, agents, lawyers, CAs, or salespersons, who claim association with Surakshakadi and suggest cash transactions. All transactions must strictly adhere to the use of our secure online payment gateway.

Changes to These Terms and Conditions

We, at our sole discretion, retain the authority to amend or replace these Terms and Conditions at any given time. In the event of a substantial revision, we commit to making reasonable efforts to notify users before the new terms come into effect. The determination of what constitutes a material change is solely within our discretion.

Upon the effective date of such revisions, your continued access or use of our service indicates your agreement to be bound by the updated terms. Should you disagree, either wholly or partially, with the new terms, we kindly request that you discontinue the use of the Application and/or Website and the associated services.

Accuracy of the product/application/website

We make diligent efforts to maintain the accuracy and relevance of the product/application/website, striving to incorporate any legal changes promptly. However, due to the rapid evolution of laws, we cannot assure that all information within the Application and/or Website or product is consistently up to date. Legal frameworks vary across jurisdictions and may undergo different interpretations by various courts. Given the personal nature of legal matters, no general information or legal tool, including the our product, can encompass every unique circumstance.

It is essential to note that the legal information provided on the Website and within the product does not constitute legal advice and is not guaranteed to be correct, comprehensive, or up-to-date. Therefore, for resolution of your specific legal concerns, we strongly recommend seeking legal advice either from our team or your legal representative who can address your situation with due diligence.

License and Usage

  • Grant of Limited License: www.surakshakadi.com and its mobile applications grant you a limited, personal, non-exclusive, and non-transferable license for the use of our product strictly for personal purposes.
  • Prohibited Activities: You explicitly acknowledge and agree that any attempt to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance, or exploit the product in any way is strictly prohibited. However, necessary modifications for filling out the document for your authorized use are permissible.
  • Usage Confirmation: By utilizing the product, you affirm that such use is exclusively intended for personal purposes. Selling or redistributing the product without our explicit written consent is strictly prohibited.

Trademarks Usage

  • Ownership and Restrictions: The trademarks, service marks, information, content, text, sounds, images, graphics, logos, page headers, page footers, button icons, scripts, and service names, including the trade name www.surakshakadi.com, explicitly constitute the trademarks of Surakshakadi. These trademarks shall not be utilized in any manner associated with any product or service not belonging to us, creating confusion among clients, experts, affiliates, or any other third party, including the public.
  • Avoiding Disparagement: The said trademarks shall not be employed in any manner that disparages or discredits Surakshakadi. Any use in violation of this principle is strictly prohibited.
  • Respect for External Trademarks: Any trademark visible on the Application and/or Website that does not pertain to our subsidiaries or us remains the property of the respective owners. These owners may or may not be affiliated with, connected to, or sponsored by us.
  • Intellectual Property Rights: Nothing in these Terms of Use shall be construed as conferring, by implication, estoppel, or otherwise, any license or right under any copyright, patent, trademark, database right, or other intellectual property or proprietary interest of surakshakadi.com, its licensors, or any third party.

Copyright Ownership and Usage
